Our Fees

We offer a variety of fee arrangements depending on the nature of your problem and what it takes to fix it.

FLAT FEE ---  We'll draft your QDRO for your Texas divorce within 2 days after we receive all documentation and payment for a flat fee of $400 per QDRO. We guarantee that the QDRO we draft will be approved by the Plan Administrator (if there are sufficient funds in the account). But remember, drafting the QDRO is only the first step in the QDRO approval process. This service is only appropriate under the following conditions:

  • You are having the QDRO prepared for a pending divorce where you will hand the QDRO to the Judge at the final hearing, or
  • You are already divorced and you're confident you can complete the approval process without our guidance (we cannot assist you with any of the other steps in the QDRO approval process under this flat fee plan), or
  • You have an attorney who can help you navigate the approval process.

If you are not comfortable completing the QDRO approval process without guidance, we suggest you consider our full service solution.

HOURLY RATE WITH A MINIMUM INITIAL RETAINER --- We provide full service resolution of your retirement problem and recovery of your retirement money. We have a detailed, systematic method of evaluating your problem. Here's how it works.

  • We discuss your retirement problem with you over the phone, or by email. (After our initial review, we can arrange an in-person conference with you anywhere in Texas).
  • We review the documents you send to us.
  • We figure out what went wrong.
  • We devise a plan to fix it.
  • We estimate the time and resources we will need to devote to fixing your problem and recovering your money.
  • We go over everything with you. We'll tell you what went wrong. We'll discuss your options. We'll provide you an estimate of what our services will cost, including the amount of the initial retainer. And then you'll decide whether you want to proceed or not.

There is no cost to you for this initial evaluation, and you are under no obligation to retain us.

Here's an example. If a QDRO was never prepared and approved in your divorce, we will complete the entire QDRO approval process for you, including obtaining the signature of the Judge. If your spouse cooperates, the initial retainer will typically be $2,000 and you will not have to do anything. If your spouse ignores us or does not cooperate, the initial retainer will be higher. And it may be necessary for you to appear in court with us.

If the solution to your problem involves extensive or protracted litigation or appeal, your costs and the initial retainer can be much higher.

HYBRID CONTINGENCY FEE/REDUCED HOURLY RATE  WITH A MINIMUM INITIAL RETAINER --- In cases where we are attempting to recover significant sums of money for you, we may be able to help reduce your out of pocket expenses with this unique approach to attorneys fees and costs. The fees you are charged on an hourly basis are significantly reduced. In exchange, we receive a percentage of the monies we recover for you. If we recover nothing, you will only pay the reduced hourly rate and costs.

This fee structure is not for everybody or every type of case. It is typically employed when we attempt to collect your retirement money that your spouse has already received and did not pay to you. The fee structure may also be appropriate in cases where we are attempting to collect damages for your divorce attorney's legal malpractice.
